Welcome to MOVE by Tess & Yoann, a service owned and operated by TANDY DIGITAL LLC (formerly operated by Entrainement MBF S.E.N.C.).
These Terms of Service (“Terms”) govern your access to and use of our website (https://joinmoveapp.com), our mobile and web applications (accessed directly or routed via our technological software provider, Movement.so), and any related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Assignment & Corporate Transition Notice:
Users are hereby notified that all contracts, accounts, subscriptions, intellectual property, rights, and operations relating to the Service previously operated by Entrainement MBF S.E.N.C. (Quebec, Canada) have been officially assigned, transferred, and novated to TANDY DIGITAL LLC. By continuing to access, browse, or use the Service after the effective date of these Terms, you expressly acknowledge and agree to this contractual assignment and acknowledge that your ongoing contractual relationship is exclusively with TANDY DIGITAL LLC.
2. Services Provided & Platform Infrastructure
MOVE by Tess & Yoann provides an online fitness service focused exclusively on guided, follow-along workouts.
Our application architecture and user access routes are delivered directly or through our third-party technological infrastructure partner, Movement.so. By subscribing, users gain access to:
• Follow-along workout videos led by Tess & Yoann
• Structured training programs designed for home workouts
• Programs that may require minimal equipment depending on the workout
All content, software, and services provided are for personal, non-commercial use only.
3. Medical & Health Disclaimer
MOVE by Tess & Yoann provides physical exercise, fitness, and educational content only.
• The Service is not a medical program and does not provide medical, nutritional, diagnostic, or therapeutic advice.
• You should consult a physician or qualified healthcare professional before starting any fitness program, especially if you have a pre-existing medical condition, cardiovascular issues, or injury.
• You are solely responsible for determining whether the workouts and intensity levels are appropriate for your health condition and physical fitness.
• You acknowledge that physical exercise involves inherent risks of bodily injury and that you use the Service entirely at your own risk.
4. User Eligibility
The Service is intended for users who are at least 16 years old, or the minimum legal age required in their jurisdiction of residence. By using the Service, you confirm that you meet this requirement and have not previously been suspended or banned from the Service.
5. Subscriptions and Pricing
We offer the following recurring subscription plans:
• Monthly: $14.99 USD per month
• Yearly: $99.99 USD per year (equivalent to $8.33 USD per month)
Prices are subject to change at any time. Any price modifications will be communicated in advance and will take effect at the start of your next billing cycle.
6. Free Trial
We may offer a one-time, 7-day free trial to new eligible users (strictly limited to one free trial per person/device/payment method). A valid payment method is required to activate the trial.
Unless cancelled at least 24 hours prior to the expiration of the 7-day period, the free trial will automatically convert into a recurring paid subscription (Monthly or Yearly, as selected during registration), and your payment method will be charged the applicable fee. We reserve the right to modify or revoke free trial eligibility at any time.
7. Payments, Billing & Third-Party Processors
Payments are processed securely through authorized merchant payment processors (including integrated processors via Movement.so).
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• All prices are quoted in USD and exclude applicable sales taxes or VAT where required by law.
• We reserve the right to suspend or terminate access immediately in cases of failed payments, chargebacks, fraudulent activity, or payment processing disputes.
8. Cancellations & Refund Policy
You may cancel your subscription at any time via your account settings or through your subscription confirmation link/email.
• Upon cancellation, your access remains active until the end of your current paid billing period.
• No full or prorated refunds are provided for partial billing periods, unused time, or accidental purchases.
• Cancelling a subscription halts future automatic renewals but does not retroactively refund past payments.
• You must cancel at least 24 hours before your renewal date to avoid being charged for the subsequent billing cycle.
9. Promo Codes and Special Offers
Promotional codes or special offers are subject to specific terms:
• Time-limited and non-transferable.
• Strictly limited to one use per account/user unless otherwise stated.
• Cannot be combined with other promotions or retroactively applied to active subscriptions.
• Have no cash value. Misuse or abuse of promotional offers may result in immediate termination of the account without refund.
10. Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. You agree to notify us immediately at info@joinmoveapp.com if you suspect any unauthorized access or security breach.
11. Acceptable Use & Conduct Restrictions
You agree not to:
• Harass, threaten, stalk, or abuse other users or instructors;
• Upload, post, or distribute illegal, offensive, explicit, or harmful content;
• Attempt to hack, disrupt, benchmark, reverse-engineer, or decompile the Service, its underlying software, layout, or visual architecture;
• Access or use the Service if you are a direct competitor, or for competitive analysis, commercial espionage, or cloning/replication of our business model and programming;
• Scrape, extract, or harvest content from the platform through automated means;
• Use the Service for unauthorized commercial distribution or resale;
• Violate any applicable local, state, national, or international laws or regulations.
Violations will result in immediate account revocation without refund, permanent platform bans, and potential legal action.
12. Intellectual Property Rights
All content, visual interfaces, graphics, design, compilation, information, data, computer code, workout videos, training structures, program sequences, logos, and trademarks available through MOVE are the exclusive property of TANDY DIGITAL LLC or its licensors. They are protected under United States and international copyright, trademark, trade secret, and unfair competition laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and view content for personal use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, scrape, clone, or exploit any part of the Service without explicit prior written authorization from TANDY DIGITAL LLC.
13. Modification & Availability of Service
We reserve the right to update, modify, suspend, or discontinue any feature, workout, or portion of the Service at any time without prior notice or liability.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TANDY DIGITAL LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TANDY DIGITAL LLC, ITS MANAGERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR PARTNERS (INCLUDING MOVEMENT.SO) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR PERSONAL INJURY ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
16. Indemnification
You agree to defend, indemnify, and hold harmless TANDY DIGITAL LLC, its affiliates, managers, officers, employees, and software/infrastructure partners (including Movement.so) from and against any claims, liabilities, damages, losses, expenses, or legal fees arising out of or in any way connected with your access to or use of the Service, or your breach of these Terms.
17. Force Majeure
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, internet disruptions, server hosting failures, cyberattacks, natural disasters, or governmental actions.
18. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of the State of [État de votre LLC], United States, without regard to its conflict of law principles.
Class Action Waiver:
YOU AND TANDY DIGITAL LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
